Government changes to whiplash claims on their way, warn leading injury claim lawyers

London, United Kingdom (prHWY.com) January 29, 2013 - United Kingdom: 29th January 2013 -Leading London no win, no fee injury lawyers, 1st Injury Claims, today reminded potential claimants of changes to rules governing the procedures behind whiplash and other personal injury and accident compensation claims, which are being implemented later on this spring.

The reforms, which come into effect in April 2013 through Part 2 of the Legal Aid, Sentencing and Punishment of Offenders Act 2012, will affect the way in which some personal injury lawyers and companies pursue payment for legal advice and representation in personal injury compensation claim cases.

A 25% cap on success fees in personal injury awards, excluding damages for future care and loss, will be introduced under the reforms. Lawyers will be required to provide clear information to the claimant on how the success fees have been calculated.

In addition, the existing Road Traffic Accident personal injury scheme will be extended to include relevant claims up to £25,000 and will include employers' liability and public liability claims. Fixed recoverable costs will also be reduced from April 2013. However, the practice of a solicitor not charging his or her client for their services following an unsuccessful outcome - in other words, the traditional concept of 'no win no fee' - will remain in place.
