A legal cost draftsman also know as legal costs negotiators will certainly be enlightened on this situation which was tackled during the seminar; it was pointed out that claimants will be the ones who will most likely benefit from these reforms, in terms of the sanction that will be held against any defendant. It was also clarified that the existing rules will not be changed instead there will be certain additions to it. For instances, wherein the claimant during the trial will be able to beat their own part 36 offer, and then there could be a possibility that the court will grant additional 10% of costs to the claimant which is subject to a cap or an additional 10% of damages.
This policy is mainly intended to encourage the defendant to have a reasonable offer on their part 36 which will be settled before the trial. It is important to also consider that the current risk of having to pay for the defendant's costs is still applicable in cases wherein such offer will not be beaten up.
Somehow, this will not be of that a serious issue to any law costs draftsman, since there is certain after-the-event or ATE insurance policy that has the capability of covering the costs needed which has been failed to meet for the necessary offer to be able to beat part 36 offers.
