The research in this area tends to bear that out, particularly with public defenders, who are more likely than private attorneys to be new attorneys with relatively little experience; have very high caseloads (clients assigned to them); and represent defendants who are indigent and have prior criminal histories. This difficult situation is aggravated by limited financial resources for investigations to assist in the defense preparation and more conservative policy changes that increased the number of defendants as a result of mandatory sentencing policies and sharply increased drug caseloads over the last 20 years. Consequently, some have argued that there are two types of defendants in the United States: the "haves" (those with private attorneys) and the "have-nots" (those with court-appointed counsel or public defenders).
