Austin, TX - In his practice, family law attorney James W. When deciding what is best for the children, the courts do not evaluate individuals based on gender, but rather on the parent who will be the best caregiver. Sometimes a mother's negative condition or behavior is obvious to the court, such as a mother who moves around a lot, has documented mental health issues (other than depression), substance abuse problems, or has a history with child protective services. "These are the obvious things where dads can win primary custody," says Evans.

When the scales are not so obviously weighted in favor of the father, Evans says that the nuances, or finer distinctions, tend to determine the outcome of the case. Questions such as these become important to the father's case: Does the child have special needs? Is the child in school? How far apart do the parents live? Another important factor in the custody evaluation is the ability of the parents to work together. This might seem like a small thing; however, a mother who withholds a child's school schedule from the father or fails to tell him about concerts or games displays an inability to cooperate. The lack of cooperation is a trait that can be highlighted in favor of the father.

When deciding who will have primary custody of a child, the court may ask, 'Who is the more stable parent? Who is the most permanent parent?' In the final analysis, Evans advises clients to ask themselves this question: Why should a judge trust you to be the primary caregiver of your children?
