Inmate Convicted of Double Homicide Released to Parole Supervision

Recently, the New York legislature and the New York Division of Parole (in response to recent adverse court decisions and criticisms against the Board's previous seemingly automatic "knee-jerk" refusals to grant parole release to violent offenders) passed new legislation and regulations pertaining to standards and factors to be considered when assessing a candidate's likelihood to be able to live in the community without violating the law. These new provisions ( Correction Law Section 112(4) and Executive Law Section 259-c(4)) have shifted away from the traditional and restrictive focus on the seriousness of the offense toward a more comprehensive consideration of other relevant factors, such as the rehabilitative efforts and institutional progress of the inmate. No longer is the primary (if not sole) focus on who the individual was at the time that the crimes were committed. Now, the appropriate focus is on who the person is now as reflected by rehabilitative and educational programs and degrees obtained while incarcerated, his or her institutional record, and maturity and awareness level achieved after years of incarceration.
Norma Lee, a retired licensed nurse and devoted mother of Lee, had been praying for years that her son be given another chance at life and that he be released back into society while she was still alive. With each negative decision from the Board of Parole over the past 18 years since Roger became eligible for parole, her hopes were steadily diminishing and her discouragement grew.
In his application for the parole release of Lee, Knapp highlighted the transitions Lee had gone through and the progress Lee had made for the past 32 years, as well as the fact that he was a different person than he was at the age of 18 when these crimes were committed. Based upon Knapp's presentation and the recent amendments to Executive Law Section 259-c(4) and Correction Law Section 112(4), the Board of Parole agreed, and Lee will soon be released to fulfill the dreams of his mother.
