ADA to Require Accessibility

Houston, TX (prHWY.com) July 2, 2012 - Houston, TX (June 27, 2012) - The 2010 ADA, revised requirements on September 15, 2010 to implement for state and local pool facilities to include "Accessible Design" in pool facilities nationwide. The disabled will no longer be excluded from swimming in pools, wading pools and spa pools. This act is designed to prohibit discrimination toward Americans with disabilities. "Accessible means for entry for pools," from Section 242, 1009 of the ADA, requires special lifts or sloped entrances.

We must hold pool owners accountable to renovate for "Accessible Design," or disabled Americans will continue to suffer the consequences of non-compliance. Two categories have been defined, large pool with 300 linear feet or more, which requires two pool lifts or sloped entries and small pools with less than 300 linear feet, which will require one pool lift or sloped entry.

The Americans with Disabilities Act has distinguished two entities that this law will affect; Title II is state and local government services and Title III is public and commercial facilities. Non-compliance for private pools can result in civil lawsuits, and public pools that are funded by the state or government could forfeit their grants. Non-compliance fines can reach up to $50,000. The outcome; thousands of pools will need to be equipped with pool lifts to accommodate disabled Americans.

The original enforcement date was March 31st, but after a large number of responses from many pool owners, the Department of Justice extended the deadline until January 31st, 2013. Many pool owners feel intimidated by the idea, but there are pool lifts, like the Kenmark Pool Lift system, that are fairly reasonable in price. Disabled Americans should not pay the price, by sitting pool side anymore. There are tax incentives available for small business owners to help offset the price of giving disabled Americans the ability to take part in pool activities. The result; accommodation and access to pools and pool events in public and private pools for disabled Americans.

The changes will affect pool owners the most, but will give disabled Americans the ability and access to pools and activities they were not able to partake in before. Please give disabled Americans the ability to do every activity that is taken for granted by every other American. They deserve to have the same rights, and the 2010 American's with Disabilities Act will bring us closer to equality around the states for every American.
