Delhi, India (prHWY.com) August 31, 2012 - The Delhi High Court on 29th August, 2012 disposed a Public Interest Petition filed under the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 seeking action against Nirmal Baba for allegedly advertising and practicing magic remedies through print and electronic media. The Division Bench of the Acting Chief Justice A.K. Sikri and Justice Rajiv Sahai Endlaw examined and held that no material was found to prosecute Shri Nirmaljeet Singh Narula or Nirmal Baba.

The High Court on 16th May, 2012 directed the counsel for GNCTD to file a status report examining the allegations against Nirmal Baba. The status report was filed by GNCTD on 29th June, 2012 wherein it was clarified that no specific facts or instances or type of diseases were claimed to be cured or any such evidence has been mentioned or adduced against Nirmal Baba in the Petition that can be said to violate the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954.
The Petition filed by A.K. Jain alleging that Nirmal Baba had been claiming to offer "magical treatment" was disposed of observing that Nirmal Baba did not give any medicine related advice through advertisements which could affect the health of the human or distributed any magical remedies related substances. It was contended on behalf of Nirmal Baba that he has not indulged in any advertisement through hoardings, pamphlets, posters and emphasized only the values of truth, selfless prayer and devotion to one's duties. The allegations made in the Petition and the evidence adduced of a photograph of Nirmal Baba with one hand raised, are insubstantial to allege the violation under the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954. The Petition was disposed in the absence of any substantial ground as it relied on vague evidences to support the averments.

GNCTD counsel Najmi Wajiri further apprised the High Court that a letter has been written to Ministry of Information & Broadcasting, Press Information Bureau, the Press Council of India and the Advertising Standards Council of India wherein they have been informed that it has come to the notice of the drugs control department that several persons/firms are giving advertisement in the electronic media as well as in the print media about certain drugs/articles/machines whose usage, as per their claims, would lead to the cure of such diseases, disorder or condition. These advertisements are often published with a view to mislead the general public. In view of the above, the authorities are requested to bring to the knowledge of the concerned TV Channels, electronic and print media, newspapers/periodicals/magazines/publications and other concerned persons/firms not to allow such advertisements for being telecast/ printed in their channels/newspapers/magazines etc. which are in contravention of the different provisions of the above referred Act or Rules framed thereunder.
