Denver criminal defense attorney provides insight about James Holmes' court appearance

Hollywood, FL (prHWY.com) September 14, 2012 - Denver, CO - Colorado criminal defense attorney Kimberly Diego was interviewed by E! Online as an outside expert regarding the bizarre appearance James Holmes displayed in his court appearance on July 23. Holmes entered an Aurora, CO movie theater around midnight on Friday, July 20, as the movie "The Dark Knight Rises" was about to begin. Dressed in riot gear and wielding at least three weapons, he allegedly set off two smoke bombs before opening fire on the theater-goers with an assault rifle, shotgun, and a handgun. Twelve people died in the attack, and 58 were wounded.

In his first court appearance in the Arapahoe County District Court on July 23 in Centennial, CO, Holmes's frizzy red-orange hair and dazed expression created a stir. E! Online reporters Rebecca Macatee and Claudia Rosenbaum asked Ms. Diego, who is not associated with the case, why Holmes was not cleaned up before he appeared before a judge. Ms. Diego stated, "I do imagine that before a jury trial there would be some changes in his appearance because his appearance in the minds of the jury would be very important. Of course, at trial his appearance is going to be radically different."

Looking dazed and groggy in the courtroom, Holmes appeared to be sedated. Ms. Diego explained that he could have been on some kind of medication administered in jail, or he could have taken medication prescribed to him, such as the Vicodin he allegedly took before he went on his murderous rampage.

Ms. Diego predicted that Holmes's defense lawyer will raise the issue of mental competency. She explained, "He would be transported to the state mental hospital in Pueblo, Colorado, to do a full mental evaluation. They may decide that he may never be competent or that he would be rehabilitated through medication and treatment." For now, Holmes is being held on first-degree murder charges and is in solitary confinement.
