The UK Spouse Visa also referred to as the UK Marriage visa allows foreign nationals to settle in the UK with their settled Husband, Wife or Civil Partner. If they are not married or in a civil partnership, they may apply for a fiance visa instead. A settled person is someone who either has British Citizenship or permanent residency in the UK
Before applying for a British Spouse visa you must read the following useful information;
Applications submitted on or before 8th July 2012:
If the application for a UK Marriage visa was submitted on or before the 8th of July 2012 the application will be considered if both the applicant and their sponsor i.e. husband, wife or civil partner were at least 18 years of age. Under this category of UK Visa, the applicant and/or their partner must also provide evidence that they are financially secure and have adequate accommodation.
The applicant may include dependent children under the age of 18 on their application. The child may apply for .a British passport under the British Nationality Act of 1981.
Applications submitted on or after 9th July 2012:
The UK government implemented some changes to the UK Spouse visa application on the 9th of July 2012. As per the new legislation for their application to be considered for the UK visa the applicant and their spouse must be 18 years or older. If the application is successful, the applicant will usually be given an initial visa for a period of 30 months if they are applying for further leave to remain from within the UK or 33 months if they are applying for entry clearance from outside of the UK.
Upon completion of this initial period the applicant will need to apply for an extension to their visa. They must provide evidence to demonstrate the genuineness and sustainability of their marriage. If successful, they will be granted with an extension of 30 months from within the UK. Once they complete a continuous period of five years in the UK they may apply for settlement in the UK.
