(prHWY.com) January 10, 2013 - Victoria, Australia -- i3 Group is a
payroll specialists services provider offering high standards of customer service and technical expertise. i3 Group reports that the Australian House of representatives has recently passed the Fair Work Amendment Bill 2012 and the bill is now awaiting royal ascent so that it can be made into law.
The Fair Work Act of 2009 has also been amended through the bill, as per the recommendations of the Independent Fair Work Act Review and other stakeholders like the National Workplace Relations Consultative Council, Fair Work Australia, the Fair Work Ombudsman and others. Many of the amendments are technical.
A spokesperson from i3 Group said that these developments are going to impact the way businesses operate in several ways.
Fair Work Australia is now going to be renamed as the Fair Work Commission. Before, if a person had reason to believe that he or she was unfairly dismissed, the person could lodge a claim with Fair Work Australia within fourteen days. This has now been increased to twenty one days. Two more Vice president positions have also been added to the Fair Work Commission. Selections to these positions will be merit based, transparent, open and will be advertised publicly.
The powers of the Fair Work Commission have been increased. In some circumstances, it can dismiss applications. It has also been given the power to award costs.
Based on an inquiry by the Productivity Commission, the Fair Work Commission will implement a process through which applications will be received from funds wishing to include default MySuper products in modern awards. Further, MySuper products can be offered by superannuation funds from the 1st of July, 2013.
Opt-out clauses will no longer be permitted in enterprise agreements. Single employees cannot enter into enterprise agreements of a statutory nature.
i3 Group says that the reform process is not going to stop here. The government is going to work with employees, employers and representatives to implement the remaining recommendations of the review panel. These concern applications for scope order, applications for variations in modern awards and action ballots (protected).
