JAMES W. EVANS LAW OFFICE GUIDES DIVORCING CLIENTS ON PATH TO RESOLUTION
Austin attorney helps clients choose the right legal path for their divorce
(prHWY.com) May 23, 2012 - Austin, TX --
Austin, TX - When couples decide to end their marriage and go their separate ways, they must decide on a legal path. The path they choose will reflect their personalities, values, and issues. Their choice will also shorten -- or lengthen -- the legal process, which translates into expense. Some paths cost more than others. So what choices are available on this unchartered journey? Family law attorney James W. Evans says that in family law, there are really four kinds of [divorce] cases: (1) agreed and uncontested; (2) mediation; (3) collaborative law; and (4) litigation. As a board-certified family lawyer, Mr. Evans guides his divorcing clients to the path that best fits their situation.
(1) Agreed and Uncontested. In an agreed and uncontested divorce proceeding, clients communicate, reach consensus, and resolve their divorce by agreement.
(2) Mediation. Divorce mediation is for couples who want to go about their divorce in a civil manner outside of the courts. A divorce mediator helps facilitate the process, handling the legal side of the proceeding and offering personal advice when needed.
(3) Collaborative law. Collaborative law is for couples who want to avoid litigation. This path requires both parties to agree not to litigate by trial, and it demands a high degree of transparency. Both sides must disclose all necessary information--financial and personal. Through a series of meetings, the divorce is negotiated to reach an agreement. In addition to their attorneys, other experts (accountants or psychotherapists, for example) may be present.
