Florida law firm Musca Law is representing Roop in the death of door-to-door meat salesman

Myers. Rainey was employed as a door-to-door salesman for Blue Ribbon Steak and Seafood of Cape Coral. Roop is currently being held in Lee County without bond. Mr. Musca initially requested a bond of $50,000, but a Lee County judge denied the request "due to the serious nature of the crime." Mr. Musca was disappointed: "Obviously, that wasn't the result we were looking for. Pending a thorough and complete investigation on the matter, we thought a bond would have been appropriate." Roop, he says, is entitled to a complete defense. "The facts and circumstances that gave rise to the allegations need to be researched fully-a well structured methodical approach," said the attorney. "Not guilty plea will be entered right away along with the demand for all evidence," Mr. Musca stated.
According to the Cape Police probable cause affidavit, on July 25, 2012, Roop pulled a 9mm Glock from his pocket as Rainey walked down the driveway of Roop's home in Cape Coral toward Roop's truck after ringing his doorbell and finding no one at home. Roop fired once, striking Rainey in the shoulder. As Rainey lay wounded and bleeding in the driveway, Roop shot Rainey again, this time in the back of the head, killing him.
Explaining his actions to police after the shooting, Roop said he was "more than a little nervous" as Rainey walked down the driveway toward his truck. Rainey, Roop said, had ignored three no trespassing signs on the property and appeared to have something in his hand. When police asked Roop why he shot Rainey when he was on the ground, Roop said "for effect;" he didn't want Rainey to have "the chance to do something to me." A company order brochure and cell phone were found near Rainey's body.
This is not the first time Roop has run afoul of the law. Seven years ago, he pulled a weapon and threatened a power company meter reader who had walked onto his property. Roop was charged with improper exhibition of a weapon for aiming his gun directly at the meter reader. Roop was found not guilty by a jury. According to Attorney Rinard, it is the only charge on Roop's record.
When asked his side of the story, Attorney Musca replied, "The facts and circumstances which gave rise to the allegation are still being considered, researched, and investigated by this office."
"The investigation was incomplete and we're more confident going forward that we are going to learn more and more about what happened here that has not been brought to the public's attention," Mr. Musca commented. Attorney Rinard said that it was too early to tell whether Florida's stand-your-ground law might be used as a defense.
